Breathwork by Inner State – Terms of Service

Welcome to Breathwork by Inner State. By downloading, installing, or using our app, you agree to be bound by these Terms of Service and our Privacy Policy. Please read them carefully before using the app.

1. Acceptance of Terms

By accessing or using the Breathwork by Inner State app (“the App”), you agree to be bound by these Terms of Service and our Privacy Policy. If you disagree with any part of these terms, you may not access or use our service.

2. App Store Terms

These terms are in addition to any applicable terms and conditions of your mobile device’s app marketplace (e.g., Apple App Store). You acknowledge that:

  • These terms are between you and Breathwork by Inner State, not with Apple Inc.
  • Apple has no obligation to provide maintenance or support services.
  • In the event of any failure of the app to conform to warranties, you may notify Apple for a refund.
  • Apple is not responsible for addressing any claims relating to the app.
  • Apple is a third-party beneficiary of these terms.

3. License Grant

Breathwork by Inner State is licensed, not sold, to you. You are granted a non-transferable license to use the app on any Apple-branded devices that you own or control, subject to Apple’s Usage Rules. Access may also be available via Family Sharing or volume purchasing. You may not copy, modify, distribute, or create derivative works from the app except as expressly permitted in these Terms.

4. Subscription Terms

Breathwork by Inner State offers auto-renewable subscriptions with the following terms:

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period.
  • You can manage and cancel your subscription by going to your Account Settings after purchase.
  • Refunds are generally not provided for unused portions of a subscription or lifetime access, except where required by applicable law.

5. User Responsibilities

As a user of Breathwork by Inner State, you agree to:

  • Provide accurate and complete information when creating an account.
  • Maintain the security of your account.
  • Use the app in compliance with all applicable laws.
  • Not attempt to reverse engineer or modify the app.

6. Medical Disclaimer and Safety Warning

6.1 Not Medical Advice: Breathwork by Inner State is not a medical device or healthcare provider. The App is designed for general wellbeing purposes only. We do not provide medical advice, diagnosis, or treatment. Always consult qualified healthcare professionals for medical concerns.

6.2 Contraindications: Certain breathing techniques offered in the App are intense and involve hyperventilation or breath-holding. DO NOT use the App without prior medical consultation if you have a history of:

  • Cardiovascular disease or high blood pressure
  • Glaucoma or retinal detachment
  • Epilepsy or history of seizures
  • Panic attacks or severe anxiety
  • Aneurysms
  • Pregnancy
  • Recent surgery or injury

6.3 Safety Environment: Dizziness, lightheadedness, or temporary loss of consciousness can occur during intense breathwork. NEVER use the App or practice its techniques while driving, operating heavy machinery, or while in or near water (e.g., in a bathtub, swimming pool, or open water) where fainting could lead to drowning or injury. Always practice in a safe, stable environment, preferably seated or lying down.

7. Assumption of Risk

By using the App, you voluntarily and knowingly assume all risks associated with breathing exercises, including physical or mental injury. You acknowledge that you are responsible for monitoring your own physical condition and will stop the practice immediately if you experience pain, severe dizziness, or any discomfort that feels unsafe.

8. Intellectual Property

All content in the Breathwork by Inner State app, including but not limited to text, graphics, logos, and software, is our property and is protected by copyright and other intellectual property laws. You may not reproduce, modify, or distribute any part of the app without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

  • The app is provided “as is” without warranties of any kind.
  • Inner State shall not be liable for any personal injury, property damage, or incidental, indirect, or consequential damages arising from your use of the app.
  • Our total liability shall not exceed the amount you paid for the app or subscription in the twelve months preceding the claim.

10. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes via the app or email. Continued use of the app after changes constitutes acceptance of the new terms.

11. Termination

We may terminate or suspend your access to the app immediately, without prior notice, for any reason including breach of these Terms. All provisions of the Terms which by their nature should survive termination shall survive.

12. Lifetime Access Purchases

Inner State may offer one-time purchases that grant lifetime access to certain features. Payment will be charged to your Apple ID account. Lifetime access refers to the lifetime of the app. If the app is discontinued, access may end at our discretion. Lifetime purchases are non-transferable and non-refundable except where required by law.

13. Legal Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo and are not identified as a prohibited or restricted party.

15. Governing Law
